Garrick Law successfully represented a Parent embroiled in family proceedings, in respect of an offence of failing to ensure a child’s regular attendance at school contrary to Section 444 of the Education Act 1996. This is a strict liability offence and rare to defend successfully. Following the instruction of a medical expert and the drafting of a detailed defence case statement, the Local Authority accepted that the proceedings were not in the public interest, despite the case being listed for trial. As such, the client found not guilty of the offences and retained her good character.
